By continuing to use Word King, you acknowledge that you understand and agree to the following:
1. Purpose of the Software
This Software is a personal English vocabulary study tool: it recognizes words from photos on your device, looks up Chinese meanings, and helps you review them. You must ensure that your use complies with applicable local laws and regulations, including respecting the rights of others in materials you photograph.
2. Translations and study content
- Text recognition results and Chinese meanings are machine-generated (meanings are fetched from Google Translate’s public service) and may be inaccurate or incomplete. You can edit meanings in the app.
- Word King is a study aid only. It does not guarantee any learning, exam, or academic outcome, and you should verify important content against authoritative references.
- To the extent permitted by law, you agree to indemnify and hold harmless Hansonsoft and its affiliates from third-party claims arising out of your use, content you photograph or enter, or your breach of these Terms.
3. Device
This Software does not require an account or login. Camera and photo library access are used only to take or pick the image to recognize. You are responsible for your device and its security.
4. Data
- Your word bank, progress, wrong answers, hidden words, and edited meanings are stored only on your device. See the Privacy Policy.
- Deleting the app or clearing its data removes this data. Except where mandatory law expressly requires otherwise, Hansonsoft has no direct liability for data loss, corruption, or failed recovery for any reason.
5. Free use and advertising
This Software is free to use and offers no in-app purchases. It is supported by Google AdMob banner and interstitial ads. Ad content is provided by third parties; Hansonsoft is not responsible for third-party ads or the sites or apps they link to.
6. Disclaimer, limitation of liability, and liability cap
- Provided as is: This Software is provided “as is” (As Is) and “as available” (As Available). Hansonsoft does not warrant that operation will be absolutely error-free or uninterrupted, or that all defects will be fixed immediately. To the maximum extent permitted by applicable law, Hansonsoft disclaims express or implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Technical matters and availability: Hansonsoft is not liable for unavailability, malfunction, defects, or delay caused by network failure, third-party service outages (including translation and advertising services), force majeure, or cyberattacks. Hansonsoft is also not liable for losses caused by operating-system permission limits, device failure, abnormalities in third-party capabilities such as the app store, advertising, translation, or system voice, or user error.
- Text recognition, translations, pronunciation, and study statistics are assistive features only and do not constitute professional advice.
- Indirect damages: In no event will Hansonsoft be liable for any indirect, incidental, special, punitive, or consequential damages (including without limitation lost profits, business interruption, loss of data, or loss of business information).
- Liability cap: To the maximum extent permitted by applicable law, the total aggregate liability of Hansonsoft and its affiliates arising out of this Software or these Terms will not exceed one hundred U.S. dollars (USD $100). This cap applies in aggregate to all claims, regardless of theory (including contract, tort, or strict liability). The monetary cap and limitations in this section are your sole and exclusive remedy.
7. Dispute resolution and class-action waiver
- These Terms are governed by U.S. federal law and the laws of the State of Colorado, excluding conflict-of-law rules.
- Disputes arising out of this Software or these Terms shall first be addressed in good-faith consultation; if unresolved, either party may bring an action only in an individual capacity in the state or federal courts of competent jurisdiction in Colorado, USA.
- Class-action waiver: To the extent permitted by law, you waive any right to bring or participate in a class, collective, representative, or similar proceeding, and may assert rights only in your individual capacity.
- Except where the law prohibits shortening the period, any claim must be filed within twelve (12) months after it arose or after you reasonably should have known of it; otherwise it is waived.
- In any action arising out of these Terms or this Software, the prevailing party is entitled to recover reasonable attorneys’ fees and other litigation costs from the other party.
8. Prohibited conduct
Reverse engineering, distributing unauthorized installers, interfering with ads, and misusing the Hansonsoft / Word King brand are prohibited. Intellectual property in this Software and related interfaces, documentation, and marks belongs to Hansonsoft or the relevant rights holders.
9. Changes
We may update these Terms. Material changes will be shown in-app or published on this page; continued use means you accept the updated Terms.

二、释义与学习内容
- 文字识别结果与中文释义均为机器生成（释义来自 Google 翻译公共服务），可能不准确或不完整。您可在应用内修改释义。
- 背词哥仅为学习辅助工具，不保证任何学习、考试或学业结果；重要内容请以权威资料为准。
- 在法律允许范围内，您同意就因您的使用、您拍摄或录入的内容或您违反本条款而引起的第三方索赔，赔偿并使 Hansonsoft 及其关联方免受损害。
三、设备
本软件无需注册账号或登录。相机与相册权限仅用于拍摄或选取待识别的图片。设备及其安全由您自行负责。
四、数据
- 词库、学习进度、错题、隐藏的单词与您编辑的释义仅保存在您本机。详见 隐私政策。
- 删除应用或清除应用数据将删除上述数据。因任何原因导致的数据丢失、损坏或恢复失败，除法律有明确强制性规定外，Hansonsoft 不承担直接赔偿责任。
五、免费与广告
本软件免费使用，无任何应用内购买，通过 Google AdMob 横幅与插屏广告支持运营。广告内容由第三方提供，Hansonsoft 不对第三方广告及其链接的网站或应用负责。
六、免责声明、责任限制与赔偿上限
- 按现状提供：本软件按「现状」（As Is）和「现有 / 可用」（As Available）状态提供。Hansonsoft 不保证软件运行绝对无错、无中断，亦不保证所有缺陷都能得到即时修复；在适用法律允许的最大范围内，不作适销性、特定用途适用性或不侵权等明示或默示保证。
- 技术与可用性：因网络故障、第三方服务（含翻译与广告服务）中断、不可抗力或黑客攻击等原因导致的软件不可用、功能异常、缺陷或延迟，Hansonsoft 不承担责任。另亦不对因系统权限限制、设备故障、应用商店/广告/翻译/系统语音等第三方能力异常或用户误操作造成的损失承担责任。
- 文字识别、翻译释义、发音与学习统计仅为辅助功能，不构成专业建议。
- 间接损害：在任何情况下，Hansonsoft 均不对任何间接的、附带的、特别的、惩罚性的或衍生性的损害（包括但不限于利润损失、营业中断、数据丢失或业务信息丢失）承担责任。
- 赔偿上限：在适用法律允许的最大范围内，Hansonsoft 及其关联方就本软件或本条款引起的全部责任合计，不超过一百美元（USD $100）。上述上限适用所有索赔合计，不论诉因（包括合同、侵权、严格责任等）。本条规定的金额上限与责任限制构成您唯一且排他的救济手段（sole and exclusive remedy）。
七、争议解决与集体诉讼弃权
- 本条款受美国联邦法律及科罗拉多州法律管辖（不含冲突法规则）。
- 因本软件或本条款引起的争议，双方应先善意协商；协商不成的，仅可在美国科罗拉多州有管辖权的州法院或联邦法院以个人名义提起诉讼。
- 集体诉讼弃权：在法律允许范围内，您放弃以集体、集体仲裁、代表或类似集体程序起诉或参与的权利，仅得以个人身份主张权利。
- 除法律禁止缩短者外，任何索赔须在事由发生或您合理应知悉后十二（12）个月内提出，逾期视为放弃。
- 在任何因本条款或本软件引发的诉讼中，胜诉方有权向败诉方追偿合理的律师费及其他诉讼成本。
八、禁止行为
禁止反向工程、传播未经授权的安装包、干扰广告展示，以及冒用 Hansonsoft / 背词哥品牌。本软件及相关界面、文档、标识的知识产权归 Hansonsoft 或权利人所有。
九、变更
我们可能更新本条款。重要变更将通过软件内提示或本页公布；继续使用即视为接受更新后的条款。
